Abstract

Moving from the observation that the use of AI tools in civil proceedings, if ever constitutionally tolerable, seems at present to be of little use, especially with reference to the goal of reducing inequalities, the contribution investigates AI potential applications outside, before, and in sight of the trial: in particular, new technologies’ potential impact on access to justice is explored. The debate on this topic has already begun to develop abroad, but it must be declined taking into account the peculiarities of the Italian system: it is thus claimed that, here, the use of AI tools may (and perhaps should) be complemented by the initiatives that institutions (including local ones) have already launched.
