Moving from the well-known lacuna in the Civil Code of 1865 with regard to neighborly relations and immissions, emphasis has been placed on the oscillation of the relevant jurisprudential pronouncements: pronouncements consistently inspired by the solutions of Roman jurists as a result of the use of a procedure of abstraction by induction of the principles that made their way into the classical era, specifically those contained in Ulp. 17 ad ed. D. 8.5.8.5, 6, and 7.
