TENTATIVI INDIPENDENTISTI NEL COSTITUZIONALISMO CONTEMPORANEO TRA AUTODETERMINAZIONE, SECESSIONE E INTEGRITÀ TERRITORIALE DELLO STATO: IL CASO CATALANO

Secessionism is a phenomenon which has affected various legal systems, such as Catalunian one, spreading the debate around the possibility for a region to secede from the State in order to proclaim its independence therefore to assert its international legal personality. The uncertainty about the exact legal status of secessionism lead us to investigate the so-called “Catalan question”, which demonstrated how contemporary constitutionalism tend towards territorial integrity of the State, although the effort to ensure the linguistic, ethnic and local pluralism. Indeed Constitutions recognize the State as a single entity capable of incorporating and guaranteeing diversities through the unity of the nation.
