Assistive technologies allow people with disabilities - even severe ones - to express their will in alternative ways to verbal communication, as well as to carry out actions that would otherwise not be permitted to them. Firstly, this research work examines the structure and functionality of Brain-Computer Interface technologies and also investigates what legal issues could emerge following their use. Secondly, the contribution aims to understand the legal nature of the data processed by these technologies, so as to be able to verify the legitimacy of their processing. Finally, the possible critical issues deriving from the use of BCI technologies with respect to compliance with the art. 25 GDPR (privacy by design) and the use of blockchain is being evaluated as at least a partial solution.
