With judgement no. 52/2025, the Constitutional Court only partially corrected the unequal treatment of mothers and fathers in matters of precautionary measures and imprisonment, declaring unconstitutional the prohibition on granting special home detention to fathers in cases where the mother is deceased or incapacitated, but third parties are available to care for the children. This outcome highlights the limits of a conservative stance toward social and cultural changes concerning shared parenting, which negatively affects the best interests of the child.
