The contribution aims to investigate ideological implications in EU specialized legal discourse on immigration and asylum. The analysis has evidenced the role of the EU in operationalising an ideologically based discourse and political evaluations for the Member States to comply with such legally binding instruments as Directives. In this setting 'should' appears to have quite a distinct role in determining the ideological framework for legislation in such a way that no possibility is left that an expectation may remain unfulfilled.
