Libertà e copyright nella Costituzione e nel Diritto dell'Unione

Il lavoro parte dal recentissimo regolamento dell’Autorità per le Garanzie nelle Comunicazioni sul copyright per porre tre interrogativi, ai quali risponde in coerenza con i parametri della compatibilità costituzionale ed europea. Le Autorità indipendenti si possono ancora definire “istanze di regolazione” idonee a rendere una prestazione di garanzia? Il regolamento in esame è all’altezza del compito affidatogli: dettare una misura di equilibrio tra le libertà fondamentali dei cittadini-naviganti e il diritto allo sfruttamento dell’opera d’ingegno? E, in caso di risposta negativa alle prime due domande, a chi rivolgere il nostro bisogno di protezione e quale compito affidare alle A.I.? L’Autrice suggerisce un antico rimedio per ricondurre alla legittimità costituzionale ed europea quanto al momento non lo: unicuique suum tribuere. My work originates from the latest regulation issued by the Autorità per le Garanzie nelle Comunicazioni (the Italian Authority on Communications) concerning copyright. It then branches along three questions, which will be answered in compliance with the Italian Constitution and the Union system. Can Independent Authorities still be defined “regulating bodies”, suitable to fulfil warranties? Does the regulation in question rise to its challenge, i.e. striking up a balance between the fundamental freedoms of the netizens and protecting intellectual property? And, should the first two questions be answered in the negative, to whom shall we turn for the protection we need, and what kind of tasks should we entrust to Independent Authorities? The author suggests an ancient remedy to bring back under constitutional and European legitimacy what currently is not: unicuique suum tribuere.
