The experience of the crisis has reopened the debate on regulatory requirements on the organizational and legal structure of banks too big to fail as measures to mitigate systemic risks. From this point of view the purpose of the new provisions on banking separation are, as far as possible, complementary to those that are strictly prudential matrix as well as crisis management and liquidation. However, contrary to risk mitigation measures, stands out the lack of recommendations or international standards on minimum level of separation of banking activities that can serve as a guideline for national regulators.
