The third scholium at B. 21.1.45, coming from C. 1.5.21 about the prohibition to testify for some categories of heretics, could assume a great importance if we consider the fact the Manichaean heresy is presented in an emblematic way, by following a sort of cliché which preserved some old roots of the heresiological orthodox system : in this sense, it is possible to consider the coexistence in the Basilica, through the decades, of juridical and ecclesiastical commentaries.
