This work focuses on ECJ’s ruling dated fourteenth of February 2019, C-54/18 which established that the term of thirty days set up by article 12, paragraph 2-bis of the Italian administrative proceedings code to challenge the final classification of tender's applicants is consistent with European Law. More precisely, this work aims to explore the ratio legis behind such term of thirty days. In this respect, this paper focuses on the distinction between the concepts of rule of law and efficacy of administrative action.

Abstract
