The boundary between a product copied and a new product, with the same functions of the existing ones, is difficult to establish, since both are based on previous common technical knowledge and the need to satisfy the consumer perception of the product. Starting from the analysis of a case study in the matter of legal challenges concerning alleged patent infringement, some considerations on this topic and patterns of new products development in established markets are presented. It emerges that technical knowledge combined with market and managers requirements and constraints induce similar products design. This is why companies developing new products based on existing concepts often face a lawsuit, moved from that competitor whose market is unjustly threatened.
