La Corte costituzionale sulla legislazione valdostana in materia di accesso al mutuo agevolato dello straniero. "Ombrelli" e "argomenti" nella sentenza 53/2024

The commentary on Constitutional Court ruling 53/2024, regarding discriminatory conditions for foreigners accessing the subsidized loan provided by Valle d’Aosta law 3/2013, analyzes the arguments and tests developed by the Court in its decision. The two distinct requirements identified by the legislature for granting the subsidy correspond to two different outcomes in terms of constitutional legitimacy. Both outcomes will be examined in light of previous constitutional case law on social rights, considering the classification of access to the subsidized loan. In contrast to this, a different way of classifying the nature of the needs is proposed.
